General Terms and Conditions of
DeSight Store UG (limited liability) for Customers (“Terms of Use”)

1.) General Regulations

The DeSight Store UG (limited liability) (hereinafter referred to as "we" or the "App Operator / Developer"), offers you (hereinafter referred to as "you" or the "customer") the opportunity to use the API of OpenAI on the domain www.desight.app and through the DeSight App (hereinafter the "App") and access ChatGPT3. The App Operator / Developer is not a party to the contract between you and the provider, does not accept declarations of will on behalf of third parties, and does not perform contracts for or on behalf of providers.

2.) Services of the App Operator / Developer

  1. We make our App available to you for free when downloading.
  2. A monthly or weekly subscription is necessary to use the App.
  3. You can use our application to access ChatGPT3 via the OpenAI API interface.

3.) Payment

The subscription necessary to use the App will be concluded directly through your Google or Apple account in the respective App Store of the provider. The contract is therefore concluded between you and the store provider.

4.) Warranty and Liability

  1. The App Operator / Developer assumes no responsibility for the accuracy and completeness of information generated during use of the App.
  2. DesSight obtains its data through the OpenAI/ChatGPT API in the Davinci-3 model, which may result in the occasional provision of incorrect or biased responses. It is therefore recommended to verify the accuracy of the model's responses. Furthermore, the model can store up to 750 words from the current conversation, but information beyond that is not stored. When using the app, all data and information is retrieved and displayed through the API from OpenAI/ChatGPT servers.   3. The app operator/developer does not provide any warranties regarding the availability of services from the providers under certain conditions.
  4. Our liability is governed by sections 599 and 600 of the German Civil Code. In case of simple negligence, we are also liable for damages arising from injury to life, body, or health.
